St. Cloud Police have arrested a man following an investigation into allegations of sexual abuse of a minor.
Ivan Oscar Martinez-Garcia, 56, was arrested Monday and charged with felony counts of capital sexual battery on a victim under 12 by a person 18 years of age or older in a familial or custodial position, lewd or lascivious molestation of a victim less than 12 years of age by an offender 18 years of age or older and showing harmful material to a minor.
According to the highly-redacted arrest affidavit obtained by the News-Gazette, the suspect was on a Facetime call with the victim and another person, presumably an adult family member, saw the suspect “rubbing his genital area over his clothing” and also observed the suspect “making facial gestures and moving his tongue during the call.”
After disconnecting the call the other subject took the victim to St. Cloud Police to make a report, and noted the victim stayed at the suspect’s Oregon Avenue house last weekend, something that doesn’t happen frequently, and noticed the suspect “appeared nervous when she arrived to pick <the victim> up.” The victim gave a report that Martinez-Garcia committed sexual battery and showed the victim pornography during the weekend visit.
Court records show Martinez-Garcia, who was scheduled to make an initial appearance in front of a judge Tuesday afternoon, was arrested in 2017 on a felony cannabis trafficking charge, and spent a year in jail.
