When your home is your castle — BVL burglary suspect shot by defending resident

A unarmed man caught breaking into an occupied house in Buenaventura Lakes Tuesday chose to ignore police commands to exit and instead was shot by an occupant, the Osceola County Sheriff’s Office reports.

David Martinez-Estrada, 28, was arrested — after a trip to the hospital — and charged with criminal mischief, burglary to an occupied dwelling, stalking, and resisting an officer without violence.

According to a Sheriff's report, deputies responded to a burglary in progress in the area of Royal Palm Drive in Kissimmee. They made contact with the suspect, who was already inside of the residence. Deputies ordered the suspect to exit the residence, but Martinez-Estrada failed to comply, the report states, and continued to go further into the residence. Moments later shots were heard from inside the residence and the suspect finally exited the residence advising he had been shot. Aid was rendered, and he was transported to the hospital.

Contact was made with one of the victims, who said she acted in defense of herself and her family when the suspect forced his way into the bedroom she and her family were in.

The Sheriff's Office is calling this case an isolated incident.
