APV victorious in lawsuit filed by Friends of Poinciana Villages (FOPV)

 Polk County Circuit Court Judge John Radabaugh has dismissed the case against the Association of Poinciana Villages (APV) that had been filed by residents Peter Jolly, Victor Destremps and Annette Brown.  This marks the last and final dismissal in a series of failed lawsuits brought by the Friends of Poinciana Villages (FOPV) and these three complainants over the last five years.  Simply put, APV has been cleared of any wrongdoing.

Now, APV will file a motion asking the court to rule that APV is entitled to recover the fees the Association had to spend to defend itself.

In August 2015, Jolly and Destremps used their positions as members of APV’s executive committee to take $1.6 million from APV’s bank accounts, as well as documents and computer hard drives from APV’s offices. APV sought and obtained an emergency injunction that ordered Jolly and Destremps to return APV’s money, records and hard drives, and APV obtained a final permanent injunction against Jolly and Destremps for their improper actions against APV and its homeowners.  However, Jolly, Destremps and several others continued to file lawsuits against the Association that we were forced to defend.

“With this victory, we want to move past these wrongful allegations and recover the extensive community funds we had to spend to defend our association against these frivolous claims,” the association stated in a press release.
