The St. Cloud City Council meeting beginning at 6 p.m. May 13th will feature the first Citizen’s Forum, where any person who desires to comment on any item not on the regular agenda can address the city council.
Each person will be requested to complete a sign-in form to be provided to the city clerk prior to addressing the council.
During the session, there will be four proclamations made. Those will be in recognition of Poppy Day, National Public Works Week, Osceola County History Month and Mercury EPM's 50-year anniversary. There also will be a presentation by the Orlando Utilities Commission.
Among several resolutions to be considered will be:
• Authorizing the mayor to enter into an agreement with the Reedy Creek Mitigation Land Bank. for purchase of Wetland Mitigation Credits, as required by the South Florida Water Management District, for the Nolte Road (Canoe Creek Road to Hickory Tree Road) project. Cost is $117,015.
• Authorizing the release of funds from the St. Cloud Police Department Federal Forfeiture Funds account to purchase three Harley-Davidson motorcycles for the St. Cloud Police Traffic Unit.
• To repeal Resolution No. 2010-055R and authorize the utilization of Osceola County, Florida Bid No. AR-09-596-LM, previously advertised for bid, which is reasonable and otherwise in the best interest of the city of St. Cloud, whose subject matter is mulching and disposal services for yard trash and vegetative waste, providing for the award thereof to Consolidated Resource Recovery, and providing an effective date. Cost is $95,565.
• Authorizing the mayor to enter into a second addendum to and extension of the agreement dated June 26, 2008, between the city of St. Cloud and Aaron’s Backflow Services for the installation of backflow prevention assemblies. Cost is $30,000.
• Authorizing the mayor to enter into a second addendum to and extension of the agreement dated June 9, 2008, between the city of St. Cloud and Discount Plumbing for the installation of backflow prevention assemblies. Cost is $30,000.
• Authorizing the mayor to enter into a task authorization to the continuing contract and agreement for professional engineering services with Osceola Engineering dated July 9, 2009, and any amendments consisting of preparing and submitting specific permit compliance reporting, associated with Florida Department of Environmental Protection ERP No. 49-228653-001, for the St. Cloud Marina. Cost is $97,680.

• Determining the responsive and responsible bidder whose bid is reasonable and/or otherwise in the best interest of the city of St. Cloud, and the award thereof in regards to ITB No. 2010-019 to Bartow Ford Company, whose subject matter is the acquisition of eight Ford 2010 Crown Victoria autos with police package and two Ford 2010 F-150 XLT package, super crew, four-door trucks.
• Authorizing the mayor to enter into a third addendum to and extension of the agreement between the city of St. Cloud and Crowder-Gulf Joint Venture, Inc. to provide for debris management and removal. Cost would be determined upon emergency.
• Authorizing the mayor to enter into a third addendum to and extension of the agreement between the city of St. Cloud and DRC Emergency Services, LLC to provide for debris management and removal. Cost would be determined upon emergency.
• Authorizing the sale, consumption and possession of alcoholic beverages by St. Cloud Main Street, in conjunction with the Osceola Riders Non Profit Organization, on city property, for a special event — Friday Night Live Street Party — June 11, July 9, Aug. 13 and Sept. 10, with conditions.
• Authorizing the sale, consumption and possession of alcoholic beverages by the St. Cloud Greater Osceola Chamber of Commerce on city property, for “July 4th Lakefront Celebration,” with conditions.
• Authorizing the mayor to enter into an interlocal agreement with Osceola County relating to the establishment of a process to annually review and consider joint funding and administration of roadway capital improvement projects.

The council also will take action on a resolution authorizing the settlement of that certain eminent domain litigation between Thomas A. Morris and Judith J. Morris related to the acquisition of property totaling approximately 2,476 square feet, located in Osceola County, for the acquisition cost of $39,500 and $18,060 in attorney fees, professional expert fees and costs; the property being acquired for the construction and expansion of Nolte Road and authorizing the mayor, city manager or the city's legal counsel to perform all acts necessary and appropriate to complete the settlement of this matter and acquisition of the subject property.
Also the council will act on a resolution authorizing the settlement of that certain eminent domain litigation between William J. Muroski and Dianna A. Muroski related to the acquisition of property totaling approximately 3,301 square feet located in Osceola County for the acquisition cost of $36,500 and $15,400 for attorney fees, professional expert fees and costs; the property being acquired for the construction and expansion of Nolte Road and authorizing the mayor, city manager or the city’s legal counsel to perform all acts necessary and appropriate to complete the settlement of this matter and acquisition of the subject property.
There also will be discussion and possible action regarding an appointment to the Historic Preservation Board.
