Following another request from the community earlier this week, Kissimmee commissioners again will consider altering their sign ordinance to allow for human signs.

Per the upcoming commission meeting’s agenda, released Friday afternoon, city staff will be recommending against allowing human signs. However, if commissioners are in favor of human signs, the agenda lists 24 “possible stipulations,” listed below, that the commissioners could consider.

Suggested stipulations, based on the Osceola County Human Sign Ordinance:

1. Allow only one human sign per business, with no other temporary signage allowed during the use of human signage.

2. Human signs should not be located within 20 feet of another human sign.

3. Human signs should not be allowed within a public right-of-way, including public sidewalks and bike paths. They also should not be located within drive aisles in a parking lot.

4. A human sign cannot interfere or physically interact with motorist, pedestrians, or bicyclist.

5. The human sign cannot shout or generate any noise that would disrupt traffic or endanger pedestrian or traffic safety. No bull horns or amplified music or speech.

6. The human signage may not utilize any form of illumination, including flashing, blinking or rotating lights.

7. Human signage should only be allowed during day light hours, while the business is open.

8. Human signage shall not utilize any attachments, including, but not limited to, balloons, ribbons, speakers or flags.

9. If the human signage includes a sign that is worn or carried, it should be limited to 12 square feet.

10. Signs may not block the view of any traffic control devices or vehicular site triangles.

11. The human signage shall not spin, twirl, swing, toss, throw or gyrate.

12. The human signage shall not stand on any object, including, but not limited to boxes, ladders, stilts and roller-skates.

13. The business must obtain a license for its human signage.

14. A definition of human signage be developed to supplement the ordinance.

15. The human sign shall not utilize animation on the sign itself, nor utilize mirrors or other reflective materials.

Other suggestions:

16. Limit human signage to an individual holding or wearing a sign or an individual wearing a costume. A sign and costume may not be present at the same time.

17. Sunset the temporary allowance for human signs on June 1, 2010 to coincide with the temporary changes to the banner and cold air balloon ordinances. This would allow any Commission action to extend the temporary ordinance to be consistent among all three types of signs.

18. Limit human signs to commercial zoning districts only. They should be prohibited in residential districts, including multi-family districts.

19. Human signage must remain on the same lot the business is located.

20. The business will carry liability insurance for the human signage. This insurance will cover the sign bearer and any damage the sign bearer may cause. Proof of insurance must be submitted at time of permit application and be produced on demand by a public official.

21. Minors may not be used as human signage.

22. A bond, in an amount determined by the City, must be held in all times by the business. Each time a human sign is found in violation, a “fine” can be paid from the bond, instead of requiring a Code Board hearing or a Citation being issued.

23. Upon the issuance of a third Code Enforcement Notice of Violation, a business’ human sign permit will be permanently revoked.

24. Human signage shall not be allowed in the downtown commercial zoning district.
