Trial delayed for suspects in St. Cloud murder case PDF Print E-mail

Three of the four suspects in a March incident off Lake Lizzie Drive in St. Cloud where an innocent woman was shot and killed for stumbling upon the robbery and shooting of an Orlando man had their trial postponed until November after court hearings this week.

Defense attorneys for Brandy Taylor, 22, her then-boyfriend David Eugene Smith, 20, and Cody White, 19, were granted continuances by Ninth Judicial Circuit Court Judge Scott Polodna after they argued the defense was not sufficiently prepared for trial.

Their trial, which is currently scheduled to occur with the foursome, which includes Kaitlyn Robare, 19, being tried together, is set for Nov. 13.

Robare also has a hearing scheduled for Oct. 1.

Smith, a registered felon and transient, and White, 19, a convicted felon, of 113 Whitney St. in Kissimmee, are charged with murder, attempted felony murder, armed robbery and possession of a firearm by a convicted felon.

Robare, of 1 Paquin Drive in St. Cloud, and Taylor, of 2086 Blackfoot Trail in St. Cloud,  are charged with accessory after the fact and providing false information to a law enforcement officer.

The suspects were linked to a March 22 shooting at 5625 Lake Lizzie Drive near Mathis Road east of St. Cloud where Anita Louise Smith, 59, was shot dead in her backyard around 2:30 a.m. after she left her home to investigate something suspicious in her yard.

David Eugene Smith, who is not related to the victim, and White were allegedly meeting Patrick Bacon, 25, of Orlando, by a shed in Smith's backyard for a drug transaction, according to police.

Bacon, who was shot in the head, survived the attack.

Taylor and Robare are both currently out on bond.

David Smith and White are being held in the Osceola County Jail on zero bond.
