Trial for Kissimmee teenager who injured St. Cloud cops pushed back PDF Print E-mail

David Penney, the Kissimmee teenager accused of shooting up a St. Cloud neighborhood and wounding two St. Cloud police officers in November 2011, had his trial Tuesday pushed back to November due to additional discovery made available to his defense attorney.

Medical records and other documents were released by the Orange/Osceola State Attorney’s Office prompting Penney’s attorney Warren Lindsey to request a continuance from Ninth Judicial Circuit Court Judge Jon B. Morgan.

Penney, 19, allegedly opened fire at a residence on Alabama Avenue in St. Cloud in the early morning hours of Nov. 21, 2011 dressed in a tactical vest and military-style clothing. During a shoot-out with St. Cloud police officers, during which Penney allegedly fired nine rounds into the patrol car, Officer Clinton Wise was shot in the right foot and Officer Spencer Endsley suffered injuries to his eyes, face and hands from the dashboard shattering from bullets.

Both officers are back on the police force.

Penney, who is currently awaiting trial in the Osceola County Jail on zero bond, suffered a self-inflicted gunshot wound to the head after the incident and spent time in the hospital recovering from his injuries. He faces nine charges including attempted first-degree murder with a firearm and aggravated assault with a firearm.

His trial is set for Nov. 26.

Ford headed for trial

The second-degree murder trial of Shamiekka Ford will be Sept. 18 after her attorney Howard Currie requested a new trial date from Ninth Judicial Circuit Court Judge Jon B. Morgan.

Ford, 33, who also is   known as “Candy” and “Gucci”, is accused of the Sept. 30, 2011 stabbing death of Alberto Cristobal Rivera-Montanez, 36, near the 192 Latin Buffet on Vine Street in Kissimmee.

According to the arrest affidavit, Ford allegedly stabbed Rivera-Montanez in the abdomen over money Rivera-Montanez owed for selling drugs for Ford. When confronted about the money, Rivera-Montanez told Ford he didn’t have it at the time but would get it for her. That’s when Ford allegedly stabbed Rivera-Montanez in the lower stomach with a pocketknife.

A motorist found Rivera-Montanez in the middle of Vine Street after he collapsed in the roadway.
