The attorney for David Alyn Penney, the Kissimmee teen accused of attacking a home and two St. Cloud Police Department officers with AK-47s in November, was granted a trial continuance Tuesday for insufficient preparedness.
The motion, approved by Ninth Circuit Court Judge Jon B. Morgan, pushed Penney’s trial back to June 4, giving the defense additional time to speak with the more than 40 witnesses the Orange-Osceola State Attorney’s Office plans to call.
Penney, 19, faces two counts of attempted first-degree murder with a firearm, two counts of aggravated battery causing great bodily harm with a firearm, three counts of aggravated assault with a firearm and one count each of shooting at, into or within a building and shooting at, into or within a law enforcement vehicle.
The two officers injured in the attack – Clinton Wise, who was shot in the foot, and Spencer Endsley, who suffered cuts to his face, eyes, hands and arms due to shattered glass – are back on the job.
